By accessing or using xKouros SaaS ("the Platform"), including our website, Telegram bot, API, and any related services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Platform Description

xKouros SaaS is a Software-as-a-Service (SaaS) marketplace platform that enables sellers to create automated digital storefronts via Telegram bots and web stores. The Platform provides:

• Automated Telegram bot infrastructure for digital product sales
• Web storefront hosting
• Payment gateway integrations (cryptocurrency)
• Order management and delivery automation
• Admin dashboard for store management

3. Marketplace Disclaimer

xKouros SaaS is a technology platform, not a seller. We do not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any of the products listed by sellers on the Platform. Sellers are independent operators who use our technology to run their businesses.

We are not responsible for:

• The quality, safety, legality, or availability of listed products
• The truth or accuracy of product descriptions
• The ability of sellers to deliver products
• The ability of buyers to pay for products
• Any disputes between buyers and sellers

4. User Responsibilities

All users (buyers and sellers) agree to:

• Comply with all applicable local, national, and international laws
• Not use the Platform for any illegal purpose
• Not list or purchase products that violate intellectual property rights
• Not engage in fraud, money laundering, or terrorist financing
• Provide accurate information when using the Platform
• Accept full responsibility for their actions on the Platform

5. Seller Obligations

Sellers who use our SaaS infrastructure agree to:

• Only list products they have the legal right to sell
• Comply with all applicable consumer protection laws
• Honor warranties and refund policies they advertise
• Respond to DMCA takedown notices within 24 hours
• Not use the Platform to sell stolen, hacked, or illegally obtained goods
• Indemnify xKouros SaaS against any claims arising from their listings

6. Prohibited Content

The following content is strictly prohibited on the Platform:

• Stolen credentials, hacked accounts, or carded goods
• Child exploitation material of any kind
• Weapons, drugs, or controlled substances
• Personal data obtained without consent
• Malware, ransomware, or hacking tools
• Content that infringes intellectual property rights
• Any product or service that violates applicable law

7. Account Termination

We reserve the right to suspend or terminate any account that violates these Terms, without notice. We may also report illegal activity to law enforcement authorities.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, xKouros SaaS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless xKouros SaaS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes shall be resolved through binding arbitration.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
